LAKEBOUND TAHOE LLC
CAPTAINED BOAT CHARTER AGREEMENT
This Captained Boat Charter Agreement ("Agreement") is entered into between Lakebound Tahoe LLC ("Owner") and the Charterer identified in the booking confirmation ("Charterer").
By booking and participating in this charter, the Charterer acknowledges and agrees to the following terms and conditions.
1. CHARTER DETAILS
The charter shall occur on the date, time, and duration selected during the booking process.The charter includes a licensed Captain provided by Lakebound Tahoe LLC. The Captain retains full operational authority over the vessel at all times.
2. PAYMENT & RESERVATION POLICY
Full payment is required at the time of booking unless otherwise agreed in writing.
Reservations are not confirmed until payment has been successfully processed.
3. CANCELLATION POLICY
Standard Cancellation Policy
•Free cancellations up to 5 days before charter start time.
•50% refund for cancellations made between 2–5 days before charter start time.
•No refunds for cancellations within 48 hours of charter start time.
Weather & Safety Cancellations
Lakebound Tahoe LLC reserves the right to delay, modify, shorten, reschedule, or cancel charters due to:
•Severe weather
•Unsafe lake conditions
•Government advisories
•Mechanical or safety concerns
In such situations, Lakebound Tahoe LLC may offer:
•Rescheduling
•Charter credit
•Partial or full refund at management discretion
Light rain, cooler temperatures, smoke, or cloudy conditions do not automatically qualify for cancellation.
Owner Cancellation
If Lakebound Tahoe LLC cancels a charter for reasons within its control, the Charterer will receive a full refund.
4. PICKUP & ARRIVAL
The Charterer agrees to arrive at least 30 minutes prior to the scheduled charter start time.
Failure to arrive on time may reduce total charter time and may result in cancellation without refund.
5. NAVIGATION LIMITS
The vessel is restricted to Lake Tahoe only.
Nighttime navigation is strictly prohibited.
The Captain retains sole authority regarding navigation, weather conditions, route selection, anchoring, and safe vessel operation.
6. PASSENGER LIMITS
The maximum number of passengers onboard shall not exceed 12 passengers total.
Children under the age of 13 are required to wear life jackets while underway.
7. CAPTAIN AUTHORITY
The Captain retains full authority regarding vessel operation, passenger safety, navigation, weather decisions, and onboard conduct at all times.
The Captain may delay, modify, shorten, or immediately terminate the charter without refund if unsafe conditions, intoxication, reckless behavior, passenger misconduct, or safety concerns arise.
Guests are strictly prohibited from operating the vessel at any time.
8. PROHIBITED ACTIVITIES
The following activities are strictly prohibited:
•Smoking onboard
•Illegal drug use
•Reckless or unsafe behavior
•Interfering with the Captain’s operation of the vessel
•Excessive intoxication
•Bringing more passengers than permitted
•Operating outside Lake Tahoe
Violation of these rules may result in immediate termination of the charter without refund.
9. FOOD, BEVERAGES & PERSONAL ITEMS
Guests are welcome to bring food and beverages onboard.
The Charterer assumes responsibility for all personal belongings brought onboard. Lakebound Tahoe LLC is not responsible for lost, stolen, or damaged personal property.
10. WEATHER CONDITIONS
Lake Tahoe weather conditions can change rapidly.
By participating in the charter, the Charterer acknowledges and accepts all risks associated with weather, water conditions, waves, wakes, and changing environmental conditions.
The Captain may terminate or modify the charter at any time if unsafe conditions arise.
11. DAMAGE RESPONSIBILITY
The Charterer agrees to be financially responsible for damage caused by:
•Reckless conduct
•Negligence
•Excessive intoxication
•Violation of safety instructions
•Intentional misconduct
Damage resulting from normal vessel operation or conditions outside the Charterer’s control shall remain the responsibility of Lakebound Tahoe LLC.
12. WATER ACTIVITIESS
wimming, tubing, floating mats, water toys, and all water-related activities are undertaken at each participant’s own risk.
Lakebound Tahoe LLC assumes no responsibility for injuries arising from swimming or water activities.
13. ASSUMPTION OF RISK
The Charterer and all guests acknowledge that boating activities involve inherent risks including but not limited to:
•Slippery surfaces
•Falls
•Drowning
•Collision
•Water hazards
•Equipment malfunction
•Passenger negligence
•Weather conditions
•Wake and wave impacts
•Water sports injuries
The Charterer voluntarily assumes all such risks associated with participation in boating activities.
14. RELEASE OF LIABILITY
To the fullest extent permitted by law, the Charterer agrees to release and hold harmless:
•Lakebound Tahoe LLC
•Vessel owner
•Captains
•Crew
•Employees
•Independent contractors
from claims arising out of ordinary negligence associated with participation in boating activities.
15. WAIVER REQUIREMENT
All passengers are required to complete and sign a Release of Liability Waiver prior to boarding the vessel.
Failure to complete required waivers may result in denial of boarding without refund.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Lakebound Tahoe LLC’s total liability arising from the charter shall not exceed the total charter fees paid by the Charterer.
17. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
18. GOVERNING LAW
This Agreement shall be governed by the laws of the State of California.Any legal action arising under this Agreement shall be brought exclusively in El Dorado County, California.
19. ELECTRONIC SIGNATURES
Electronic signatures and digital acknowledgements shall be deemed legally binding and enforceable.
20. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or representations relating to the charter.
